Terms and conditions for our January Sale Twitter competition

We’re running a competition on Twitter to promote our January Sale. Here are the terms and conditions.

  1. This promotion is open to UK residents aged 18 or over, excluding employees of O2, or any of its subsidiary companies, their families, agents or anyone else connected with this promotion. No third party entries, bulk entries or entries submitted by agents will be accepted. O2 reserves the right to verify the eligibility of entries. O2 may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the prize may be withheld until and unless O2 is satisfied with the verification.
  2. Entries not complying with these terms and conditions will be invalid.
  3. There are ten prizes to be won, 5 x £200 worth of One4all gift cards and 5 x £250 worth of One4all gift cards. These will be issued in bundles of £50 gift cards and do not expire as long as the cards have a balance on them. Voucher terms and conditions apply: http://www.one4allgiftcard.co.uk/One4all_Terms_and_Conditions.aspx. The promoter is not responsible for the voucher terms and conditions.
  4. On the day of the competition there will be January Sale competition tweets from @O2 which contain the hash tag “#O2WhatWouldYouDo”. To enter the competition to win £200 worth of vouchers you will need to respond to a tweet containing the hash tag above which asks what you would do with the £200. To enter the competition to win £250 worth of vouchers you will need to respond to a tweet containing the hash tag above which asks what you would do with the £250. The exact wording of the tweets may vary but they will contain these hash tags and will ask these questions.
  5. Your reply must be on the day O2 tweets with #O2WhatWouldYouDo, and you must include #O2WhatWouldYouDo with your suggestions. The closing date for receipt of entries is 23:59 on Friday 28th December 2012. You can enter with a tweet, a photo or a video, but your entry must be received via Twitter with the correct hash tag.
  6. O2 will choose ten winners – five people who suggest what they’d do with £200 and five who suggest what they’d do with £250. Winners will be chosen based on criteria including but not limited to the quality of their suggestion and how feasible it is to carry out using the One4all gift cards, how humorous it is and how original it is. For each competition (the competition to win £200 worth of vouchers and the competition to win £250 worth of vouchers) the top five valid entries in the opinion of our panel will each win the prize for their competition.
  7. Winners will not be required to carry out their original suggestion with the gift cards and O2 does not guarantee the winner’s original suggestion will be possible to carry out with the gift cards.
  8. Winners may be asked what they are doing with the vouchers and asked for pictures/videos/text updates for the purposes of O2 publicity.
  9. The instructions provided at the point of entry form part of the terms & conditions of this promotion, and in the event of a conflict, these terms & conditions take precedence.
  10. Prizes will be issued as soon as possible within the new year and will arrive before 1 February. The prize is awarded conditionally upon acceptance and if a winner is unable to be contacted after a reasonable period or if any prize is unclaimed or declined within a reasonable period, the prize shall be deemed as unclaimed or unaccepted and a supplementary winner may be drawn at O2’s discretion.
  11. O2 will not be responsible for any inability of a selected recipient to take up the specified Prize.
  12. O2 reserves the right to provide substitute prizes of similar value should the specified prize(s) become unavailable for reasons beyond its control. Cash or credit alternatives will not be offered. None of the prizes are transferable.
  13. O2 accepts no responsibility for incorrectly completed, lost or delayed entries, notices, acceptances, tickets or other documents related to the free prizes.
  14. In the event of fraud, abuse, and/or an error affecting the proper operation of this promotion, including the allocation of more prizes than are available, O2 reserves the right to end or suspend the promotion; amend these terms & conditions; declare void the notification of recipients; and/or to reallocate available prizes.
  15. By entering this promotion, entrants grant the promoter a transferable, sub-licensable, royalty free, non-exclusive worldwide licence to reproduce, use, distribute, and make derivative works of their entries via any media channel and in any media.
  16. Entries must be suitable for publication and display and must not be indecent or obscene. Entries must not include symbols, statements or words that are offensive to the general public or to individuals of a particular socioeconomic group, sexual orientation, ethnicity, race or religion. Entries must not breach any laws or network standards and must not include any threats to any third parties. Entries must not invade the privacy or any rights of any other person or entity.
  17. Entries must only refer to third party trade marks (i.e. trade marks not owned or controlled by the promoter) to identify those trade marks in accordance with honest practices and any such reference must be made with due cause and must not take unfair advantage of, or be detrimental to, the distinctive character or repute of the trade mark in question. Entries must not denigrate any third party trade marks. Entrants must ensure that they do not infringe third party trade mark rights with their entries.
  18. Entries must not contain third party copyright material and must not infringe any right of privacy, right of publicity, copyright or any other third party rights.
  19. Entries must be the work of the entrant. By entering the competition entrants confirm that their entry is original and that it has not been published before.
  20. If anyone other than the entrant appears in an entry the entrant must get their permission before submitting the entry.
  21. If more than one person collaborates on an entry that group of people will need to nominate one person to act as their agent and to enter the competition, accept the terms and conditions and to accept the prize on behalf of that group.
  22. If an entrant submits an entry which infringes third party rights that entrant will be responsible for any legal action that third party takes against them.
  23. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
  24. The recipients may be required to participate in publicity connected with this promotion and it is a condition of entry that the recipients agree to their name and country of residence being made publicly available if they are successful.
  25. The names of the major recipients(s) may be obtained by sending a signed handwritten request along with a stamped self-addressed envelope detailing your request to the Public Relations Team, Telefónica UK Limited, 260 Bath Road, Slough SL1 4DX, and marked with the name of the promotion.
  26. Participants’ data will be collected, stored and processed for the purposes of administering and assessing this promotion.
  27. O2’s decision is final and no correspondence will be entered into.
  28. O2 reserves the right to suspend, cancel or amend the promotion and/or review and revise these terms and conditions at any time without giving prior notice and by continuing to take part in the promotion subsequent to any revision of these terms and conditions, participants shall be deemed to have agreed to any such new or amended terms.
  29. This promotion is governed by English Law and is subject to the exclusive jurisdiction of the English courts.
